Why do trees cause boundary disputes?

Trees are a common cause of boundary disputes between neighbors, and these conflicts can become quite contentious and expensive.

Often, the issue arises because a tree can affect multiple properties. For example, you may love an old tree on your property because of its beautiful, sprawling branches. You remember your children climbing it when they were young, and you enjoy sitting in its shade on summer days. To you, the tree is a cherished and valuable part of your property that you don’t want to lose.

Your neighbor, however, might see it differently. For them, the tree could be a nuisance. Leaves or branches might fall into their yard, and they may worry that part of the tree could damage their roof or other areas of their property. Without the same sentimental connection, your neighbor might prefer to have the tree removed.

Can they trim your tree?

This difference of perspective sometimes leads to a scenario where the neighbor decides to take action and trim the tree. If you see them doing this, you might feel incredibly frustrated, believing they have no right to alter a tree that is on your property.

Legally, it is often permissible for someone to trim a tree that isn’t on their property—but only up to the property line. If branches hang over onto your neighbor’s property, they are allowed to cut them down, and you typically can’t stop them.

However, if your neighbor trims branches on your side of the property line—or removes the tree entirely—this could constitute a serious violation of your rights.
